Terms of Service

1. Acceptance of Terms

By accessing or using MyPollingUnit ("the Platform"), including the website at mypollingunit.com and the MyPollingUnit mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

The Platform is operated by JustAV Analytics ("we," "our," or "us"). We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

MyPollingUnit is a civic engagement platform that provides Nigerian citizens with tools and resources to participate in the democratic process. Our services include, but are not limited to:

  • Polling unit location finder with interactive maps
  • Voter verification through Permanent Voter Card (PVC) submission
  • Community forums organized by polling unit
  • Direct messaging between verified users
  • Community polls on civic issues
  • Voter education articles and resources
  • Election calendar and result tracking
  • Incident reporting for election irregularities
  • Nigeria exploration map with state-level data

3. Account Registration

To access certain features of the Platform, you must create an account through our authentication provider (Clerk). When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account and use the Platform. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Voter Verification

Our voter verification feature allows you to submit an image of your PVC for verification. By using this feature, you acknowledge that:

  • You are the rightful owner of the PVC being submitted
  • The information on the PVC is accurate and belongs to you
  • Verification status is for Platform purposes only and does not replace official INEC verification
  • We may use AI-powered tools to assist in verifying PVC images
  • Submitting fraudulent or stolen PVC information is strictly prohibited and may result in account termination

5. User Conduct

When using the Platform, you agree not to:

  • Post false, misleading, or defamatory content
  • Harass, threaten, or intimidate other users
  • Incite violence or promote hatred based on ethnicity, religion, gender, or political affiliation
  • Share another person's personal information without their consent
  • Use the Platform for vote buying, election fraud, or any illegal electoral activities
  • Spread misinformation about elections, candidates, or electoral processes
  • Upload malware, viruses, or other harmful content
  • Attempt to access another user's account without authorization
  • Use automated tools to scrape data or create accounts
  • Circumvent any security measures implemented on the Platform

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of users who engage in prohibited conduct.

6. User-Generated Content

You retain ownership of content you create on the Platform, including forum posts, comments, messages, and incident reports. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the operation of the Platform.

You represent and warrant that you have the right to post any content you submit and that such content does not infringe upon the intellectual property rights of any third party.

7. Advertising

The Platform may display advertisements from third-party advertising networks, including Google AdSense, as well as advertisements purchased directly through our advertising service. By using the Platform, you acknowledge that:

  • Advertisements may be displayed alongside Platform content
  • We are not responsible for the content of third-party advertisements
  • Clicking on advertisements may direct you to third-party websites governed by their own terms and privacy policies
  • Ad placement and pricing are subject to our current advertising policies

8. Payments and Refunds

Certain services on the Platform, such as advertising placements, may require payment. Payments are processed through Paystack. By making a payment, you agree to:

  • Provide accurate billing information
  • Pay all charges incurred at the prices in effect when the charges are incurred
  • Comply with Paystack's terms of service for payment processing

9. Intellectual Property

The Platform, including its design, code, logos, graphics, and all original content, is the property of JustAV Analytics and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.

The "MyPollingUnit" name and logo are trademarks of JustAV Analytics. Use of our trademarks without prior written consent is prohibited.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure
  • Information provided on the Platform, including polling unit locations and election data, is completely accurate or up-to-date
  • Voter verification results are equivalent to official INEC verification
  • User-generated content, including incident reports and election results, is accurate or reliable

MyPollingUnit is not affiliated with, endorsed by, or sponsored by the Independent National Electoral Commission (INEC) or any government body.

11. Limitation of Liability

To the fullest extent permitted by law, JustAV Analytics and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of profits, or any damages resulting from reliance on information obtained through the Platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless JustAV Analytics and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Nigeria.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall continue to apply.
